My Personal Background: Having worked at a Bay Area Law Firm as an associate fresh out of law school in the early 1990's, I understand the pressure associates are under from their firm, always demanding more hours and higher billables. As a part-time practitioner, I am fortunate that I no longer have to put the needs of a firm above the needs of a client. I practiced primarily family law, with some business law thrown in, and while I am grateful that I no longer need to worry about billables, the experience I received while working as an associate was indispensable, as I was mentored by an amazing, well-respected attorney.
In the past decade, I have provided specialized legal services as a Research Attorney, offering indispensable services to well-seasoned attorneys who hired me based on not only my experience, but also on my research and writing skills as well. I was, for all intents and purposes, the attorney's research specialist.
I have done extensive pro bono work. I volunteered for 6 years as an attorney at a non-profit that focused on issues relating to senior citizens; whether it be divorce, landlord/tenant, or probate issues, I have always been a strong advocate for the seniors in our community.
I got the idea to open my part-time practice while volunteering at the legal clinic, as I was dismayed at how many people came to us after paying thousands of dollars on legal services which did not completely address their legal needs. I thought it would be rewarding and profitable to open a small practice that focused on the marginalized clients; those that couldn't qualify for "free" services, yet couldn't afford a hefty retainer and outrageous hourly rates.

In order to help the client reduce legal fees, the Law Office of Jenni Gustafson utilizes a type of practice called: Unbundled Legal Services, Limited Scope Representation, or in laypeople's language: "a la carte". This type of law allows the client to choose only those services that they feel they need legal assistance with, resulting in typically lower fees, as the client will be assuming partial responsibility for the case. This type of practice has been approved by the State Bar of California, and is recognized as an innovative approach that should be encouraged because it brings affordable attorneys to the average consumer. Of more importance, it provides a viable alternative to "self-help" law books. If a layperson chooses to use a law book, this can be of assistance, as the layperson is more conversant in legalese and will have some familiarity and understanding of the legal process and how the courts work. However, using a self-help law book without adequate supervision can result in costly mistakes, so the very attorney fees that the client tried to avoid are now exacerbated further by the client's mistakes.
In addition to this "a la carte" approach to law, I have also been trained in Mediation, and value what is known as "ALTERNATIVE DISPUTE RESOLUTION" rather than full-scale (costly) litigation. In addition to the obvious financial costs associated with a litigated lawsuit, there are emotional costs as well. Limited Scope Representation, also known as Unbundled Legal Services, is encouraged by the State Bar of California as an affordable, effective alternative to traditional legal costs. The below resolution is from the Board of Governors of the California State Bar’s May 19, 2009 meeting:
“RESOLVED that the (California) State Bar supports the expansion of limited scope legal assistance as part of the ongoing effort to increase access to legal services; that it is important to continue to identify ways in which attorneys can appropriately provide “unbundled” legal services to provide limited and specific services to litigants without undertaking full case representation;”
Sanctioned by the State Bar, Limited Scope Representation allows many individuals, who would otherwise self-represent (“in pro per”), to obtain affordable legal services.
